Terms of Service

These Terms of Service ("Terms") govern your use of Backstretchcapper.com (the "Site") and any membership, content, or services we provide (collectively, the "Service"). By creating an account, starting a free trial, or subscribing to a membership, you agree to these Terms. If you do not agree, do not use the Service.

1. What Backstretchcapper Is — and Isn't

Backstretchcapper provides horse racing handicapping selections, historical results tracking, and related informational content for entertainment and informational purposes.

Backstretchcapper is not a wagering platform, bookmaker, or licensed gambling operator. We do not accept wagers, hold funds, or process bets of any kind. Any wagering you choose to place is done entirely through third-party, independently licensed platforms of your own choosing, subject to their own terms and the laws of your jurisdiction. We are not responsible for those platforms' conduct, policies, or outcomes.

2. Eligibility

  • You must be at least 18 years old (or 21, where required by your state) to create an account.
  • You must be legally permitted to view horse racing handicapping content and, separately, to wager on horse racing in your jurisdiction if you choose to do so. It is your sole responsibility to know and follow the laws that apply to you.
  • By creating an account, you represent that you meet these requirements.

3. Membership, Billing, and Free Trials

  • Subscription: Membership is billed on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel.
  • Free trial: New members may be offered a free trial period (currently 7 days). A valid payment method is required to start a trial. If you do not cancel before the trial ends, your card will be automatically charged for the first billing cycle at the then-current rate for your tier.
  • Founding Member pricing: A limited number of early members may lock in a discounted recurring rate. This rate applies only to the account it was issued to and is not transferable.
  • Cancellation: You may cancel anytime through your account's "Manage Subscription" option. Cancellation stops future billing but does not retroactively refund the current billing period — you retain access through the end of the period you already paid for.
  • Refunds: Except where required by law, payments are non-refundable once a billing cycle has been charged.
  • Membership cap: Total membership may be limited. We do not guarantee a seat will be available at any given time.

4. No Guarantee of Results

Handicapping selections are opinions, not guarantees. Horse racing outcomes are inherently uncertain. Past performance — including any win rate, ROI, or track record figures shown on this Site — does not guarantee future results. You are solely responsible for any wagering decisions you make and any resulting financial gain or loss. Backstretchcapper is not liable for losses incurred from wagers placed based on our content.

5. Referral Program

  • Members may receive a unique referral link to share. Referral rewards (such as account credits) are granted at our discretion once a referred signup converts to a paying membership, and are not guaranteed.
  • Referral rewards have no cash value and cannot be exchanged for cash.
  • We reserve the right to withhold or reverse referral rewards in cases of suspected fraud, abuse, or self-referral.

6. Acceptable Use

You agree not to:

  • Share your account credentials or membership access with anyone who has not independently subscribed
  • Scrape, copy, redistribute, resell, or publicly republish our picks, selections, or proprietary content
  • Attempt to create multiple accounts to abuse free trials, referral rewards, or founding-member pricing
  • Use the Service for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these Terms, without refund of any current billing period.

7. Intellectual Property

All content on this Site — including selections, analysis, track record data, and design — is the property of Backstretchcapper or its licensors. Your membership grants you a personal, non-transferable license to view this content for your own use. No other rights are granted.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Backstretchcapper and its owners, employees, and contributors will not be liable for any indirect, incidental, or consequential damages — including gambling losses — arising from your use of the Service, even if we have been advised of the possibility of such damages.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. Material changes will be reflected by updating the effective date above.

11. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law principles.
